Ugandan City lawyer Hassan Male Mabirizi Kiwanuka has dragged Kenyan government and the president of Kenya Dr Samoei William Ruto over what he termed as the “illegal’ impeachment of embattled Deputy President Geoffrey Rigathi Gachagua.
Mabirizi filed his case at the East African Court of Justice (EACJ) sub registry. The suit Reference No. 14 of 2024/ File Ref 49/24 against President William Ruto for the impeachment of his deputy Gachagua
Gachagua who was impeached by Kenya’s lower house the National Assembly had the same upheld by the upper house the Senate on Thursday night after courts declined his earlier requests to halt the impeachment process at the Senate.
He has since moved to court to halt the nomination of Prof Kithure Kindiki whom Ruto has nominated and is already gazzeted to be Kenya’s next deputy president. Gachagua is the first DP to be impeached under the 2010 Constitution of the Republic of Kenya and if even courts uphold his impeachment, he faces a 10 year ban from engaging in active politics
In Nairobi, Gachagua, whose impeachment was ratified by the Senate on Thursday night moved to the High Court on Friday and secured orders restraining President William Ruto from appointing his replacement until October 24 when the case is to be heard.
