The judicial system is in crisis with many cases pending and some have taken years to be concluded. There are cases where people have been many years on remand from 3 to 28 years. This is disregarding one of the fundamental principles of justice that justice shall not be delayed, justice delayed is justice denied.
The dispensation of justice in our judicial system is very tedious and slow as a snail. This anomaly has to be rectified so that the citizens can enjoy their rights, liberties and fairness as enshrined in the Constitution.
The citizens will always expect expeditious justice. The Courts have been slow in providing determinations leading to denying citizens their rights and causing overpopulation in prison, make them live in inhabitable conditions, and overburdening the taxpayers tax purse.
Today, the Supreme Court is the last place where cases are not settled but instead buried. Many cases in the Court have never been settled to a logical conclusion but have instead been buried.
The big question is, how can the Judiciary safeguard, guarantee our rights and liberties but also guarantee our democracy? The Judiciary has an important role in the development of our democracy.
It has to remain independent when exercising and dispensing justice without fear or without being intimidated like the late Chief Justice Ben. Kiwanuka who resisted all the threats. Justice is blind. We expect independence, transparency, truth, honesty to prevail against caprious and perfidious judgement that appeases the power to be.
Conclusively, the stopping of civilians in the Military tribunals is a turning point in the governance of the country. We thank the Supreme Court for sticking to the principles of justice.
They have unshackled themselves and the nation from bondage by a few. This is about respecting the doctrine of the separation of powers but it is very unfortunate when the President and his son the CDF of the Army, lambasted and disparaged the very ruling of the Supreme Court. The President should not forget that he took an Oath to protect and defend the Constitution.
