NO HOPE: More Misery For Besigye, Lutale As They’re Sent Back To Luzira Prisons

Led by Lord Mayor Erias Lukwago, Lawyer Medard Lubega Ssegona among others, Besigye’s legal team had applied for a harbias corpus in the high court. In so doing, they wanted to compel court to order for the release of Besigye and Lutale because they’re in prison on an inexistent remand order since the supreme court nullified the Court Martial proceedings.

The hearings had been fixed for 25th this month but as pressure mounted with loud voices for the release of Besigye to get proper medication, the high court changed and fixed the hearing for today 19th February 2025.

Hajji Obed Lutale and Dr. Kiiza Besigye were brought in court but Justice Douglas Singiza instead told prison authorities to take back accused back to custody because he couldn’t entertain seeing the sick Besigye in court.

Besigye and Lutale were taken back to prison as court proceedings continued from the Applicants and the Attorney General’s side who haven’t indicated when the transfer process of files from the court martial to civilian courts would take.

The applicants insist the Supreme Court ordered for the transfer of files but didn’t indicate the time frame and government had only 48 hours to put in consideration the orders of the apex court but this puts Besigye’s health in danger because the longer government takes to transfer the files, the longer their client will be in Luzira prisons amidst deteriorating health conditions.

Counsel Medard Lubega Ssegona indicated to the judge that the supreme court ordered for transfer of files not the body. This means Besigye can be released to seek medication as government prepares to resume his trial which is currently on halt due to the 31st supreme court ruling which put and end to the trial of civilians in Military courts.

Yesterday in a document and on his X formerly Twitter account, President Museveni vehemently stated Besigye will not be released until he faces trial. He heaped huge blame on the supreme court which halted his trial in the military court which to him was handling his case at a fast rate.

Museveni also poured cold water on the loud voices calling for Besigye’s release, he question why they’re not interested in knowing why Besigye was arrested. He also accused Besigye for blackmailing his government by endangering himself with a hunger strike which has deteriorated his health while in prison.

According to prosecution while still in the General Court Martial, Besigye , Hajji Obeid Lutale and others still at large are accused of possessing fire arms, threatening national peace. These are said to have committed these crimes in Athens-Greece, Geneva in Switzerland and Nairobi in Kenya.

Speaking shortly after the court session, a visibly disappointed Erias Lukwago revealed that they had hoped they would go back with Besigye home to get proper medication but were met with no line of hope for his release any time soon since the judge didn’t even indicate when he’ll give his judgement on the application before him.

“Unfortunately, we have not got a decision. We are walking away from the court premises without a remedy. We expected a decision to be delivered today”- said Lukwago

National Unity Platform boss Robert Kyagulanyi Ssentamu who also attended the court session slammed Justice Douglas Singiza for sending Besigye back to prison instead of hospital referring to the process as persecution not prosecution.

“Let me put this in black and white, this not prosecution but persecution. Dr. Besigye wouldn’t have been brought to court today if it was not for the pressure. You notice this is the same judge who that sent Kakwenza to prison instead of sending him to ICU, this is the same judge that said the cash bonanza at parliament was legal and this is the same judge that is sending back Dr. Besigye back to prison instead of sending him to hospital”-said Bobi Wine
