After the successful transfer of Besigye’s case file from the General Court Martial who trial of civilians was halted by the 31st January 2025 Supreme Court ruling, Besigye and his two co-accused have been fleshly charged at the Nakawa Chief Magistrates Court.
Appearing before the Nakawa Chief Magistrate’s court, the charge sheet looked revised and Besigye was charged with treason. Prosecution alleges that Besigye, Hajji Obeid Lutale, UPDF Caption Denis Oola and others still at large involved in meetings in Kampala, Geneva, Nairobi and Athens all aimed at bringing and end to Museveni’s four-decade rule.

“STATEMENT OF OFFENCE TREASON, contrary to section 23(1)(c) of the Penal Code Act, Cap 128.
PARTICULARS OF OFFENCE
COL (RTD) DR. KIZZA BESIGYE, HAJJI OBEID LUTALE, RO/12743 CAPTAIN DENIS OOLA and others still at large between the year 2023 and November 2024 at various places/ countries including Geneva in Switzerland, Athens in Greece, Nairobi in Kenya, Kampala in Uganda, contrived a plot, act or matter by force of arms to overturn the Government of Uganda as by law established and expressed or declared such plot, act or matter by utterances and overt acts”- the Charge Sheet reads in part.
Prosecution in the General court Martial had charged Besigye with illegal possession of fire arms and ammunition involving two pistols but in the new charge sheet from the DPP the charges relating to possession of fire arms look to have been dropped unless when the charge sheet is revised.
Ever since Besigye started taking on his former boss politically, he has become the most arrested and charged Ugandan in courts of laws but he has never been convicted by any competent court and most cases have always been dropped against including the famous rape charges in 2005.
This is not the first time the four time presidential candidate is charged with treason, he was slapped with charges of treason relating to swearing in himself after the elections after the disputed 2016 elections. However, the DPP Mike Chibita then dropped the charges and discontinued the case in 2019.
“This is to inform court that the Director of Public Prosecutions has decided to discontinue proceedings against Rtd Col Kizza Besigye Kifefe charged with treason”- the withdrawal form signed off by the then DPP Mike Chibita in 2019.
In 2018 People Power and firebrand politician then Robert Kyagulanyi Ssentamu alias Bobi Wine was also accused of possessing fire arms in a hotel during the Arua by-election fracas but the charges were dropped and instead charged with treason by the General Court Martial.
Besigye and Lutale have been remanded to Luzira prisons until March 07th. They were not allowed to take plea since the Chief Magistrate’s court has no jurisdiction to try him and will instead battle it out in the High Court.
