JUST IN: High Court Delivers Ruling In Petition Challenging Nomination Of Joel Ssenyonyi And 6 Others

The High Court in Kampala has finally made a ruling in a petition challenging the nomination of Leader of Opposition Joel Ssenyonyi and 6 others for Nakawa West by the Electoral Commission.

The petition was championed by Democratic Front candidate Ivan Bwowe who wanted to the Electoral Commission to declare him unopposed sighting inconsistences in the exact name of the constituency which he says it’s only him who got nominated on the right constituency name and the rest were nominated on the wrong one which is non existent.

According to Bwowe who is a lawyer, the Leader of Opposition Joel Ssenyonyi, NRM’s Herbert Anderson Burora, Rwamiti Apuuli and others got nominated for Nakawa West instead of Nakawa Division West.

His first petition to the Electoral Commission, was dismissed when the commission revealed that it was just a clerical error on the nomination forms which was corrected but all the other nomination documents carried the right constituency name and this was not evident enough to declare him unopposed like it has done in many constituencies around the country.

Lawyers of all parties faced off before high court judge Collins Acellam who promised to deliver the ruling electronically by 7th January. All parties waited for the ruling the whole day only to be delivered today early morning.

In his ruling delivered today, the judge has upheld the Electoral Commission’s earlier decision of dismissing the petition sighting that the petitioner the names Nakawa Division West constituency and Nakawa West constituency are one and the same but often used interchangeably and also the fact that the Electoral Commission corrected the error was enough ground to dismiss it.

“The control form of the Parties and all preceding documents in respect to the nomination indicate the constituency as Nakawa Division West. Thus, the clerical error was corrected and can not be held to cause confusion to anyone and most certainly not the Petitioner”= reads part of the ruling
