Dr. Kiiza Besigye and his comrade Hajj Obeid Lutale were returned to court today but the Makindye-based court has turned into a theatre of drama. It started from denying many of Besigye’s supporters entry to the court.
Another session of chaos ensued when the presiding judge ordered the arrest of lawyer Eron Kiiza who has been vocal in the military court and would take the bull by it’s horns without mincing his words. Eron Kiiza was grabbed by the collars by men in uniform inside court and they pushed him inside the dock where Besigye and Lutale were arraigned.
The other session of drama came when court rejected Kenyan Lawyer Martha Karua who painfully attained a temporary practicing certificate by the Uganda Law Council to be the lead counsel for the duo who have been on remand now for over two months.
According to a bench of 7 military judges led by the Chairman of the General Court Martial Brig Freeman Mugabe, they all contend that Besigye has never instructed Karua in writing and all the other over 30 lawyers to represent him.
These further content that that he instead instructed only three lawyers; Fredrick Mpanga, Apollo Katumba and Earnest Kalibala of AF Mpanga and company advocated whom he authorized in writing.
To the shock of many, not even his personal Lawyer Lord Mayor Erias Lukwago is among them yet Besigye insists that he has instructed several lawyers to represent him and wishes for all of them to join his legal team.
The move by the court martial to reject a licensed foreign advocate has been seen by many as another move to delay the trial of Besigye yet the same court has been adjourning severally for purposes of Martha Karua to first be granted a temporary license to represent Besigye and Lutale.
UPDATE: The General Court Martial has denied Kenyan lawyer Martha Karua and over 30 other lawyers the right to represent Dr. Kizza Besigye and Abeid Lutaale Kamulegeya, citing the absence of written instructions from the accused.
